These WhiteSky Service-Specific Terms apply to the WhiteSky Services, as defined below, and are subject to and governed by the terms and conditions of the General Terms which are incorporated herein by reference (collectively, these WhiteSky Service-Specific Terms and the General Terms are the “WhiteSky Terms”). Capitalized terms used in these Service-Specific Terms have the meanings provided in the General Terms unless otherwise defined herein.
Please carefully read the WhiteSky Terms before accessing or using the WhiteSky Services. The WhiteSky Terms may contain links to additional governing terms and conditions that are incorporated by reference and will apply depending on your use of the WhiteSky Services. By accessing or using the WhiteSky Services, or otherwise demonstrating your acceptance of the WhiteSky Terms, you accept and are bound by the WhiteSky Terms. If you do not agree to be bound by the WhiteSky Terms, then you may not access or use the WhiteSky Services.
PLEASE BE ADVISED THAT THE WHITESKY TERMS ARE SUBJECT TO THE DISPUTE RESOLUTION AGREEMENT (SEE SCHEDULE A AT THE END OF THE GENERAL TERMS, TITLED “DISPUTE RESOLUTION TERMS (ARBITRATION AGREEMENT; CLASS AND COLLECTIVE ACTION WAIVER; AND JURY TRIAL WAIVER)”), THAT GOVERNS HOW CLAIMS YOU AND REALPAGE HAVE AGAINST EACH OTHER ARE RESOLVED, WHICH WILL, WITH LIMITED EXCEPTION, REQUIRE THE PARTIES TO SUBMIT CLAIMS THEY MAY HAVE AGAINST ONE ANOTHER TO BINDING AND FINAL ARBITRATION. UNDER THE DISPUTE RESOLUTION AGREEMENT, THE PARTIES WILL (I) ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST EACH OTHER ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, AND (II) BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY ON AN INDIVIDUAL BASIS.
1. DESCRIPTION
The “WhiteSky Services” include managed communication and telecommunication services, primarily focused on Internet, video, and Voice-over-IP (VoIP) phone services for businesses and multi-dwelling units (MDU) such as apartments, student housing, and assisted living facilities. Certain of the WhiteSky Services, such as our mobile applications and web portal (collectively, the “WhiteSky Apps”), require you to create and maintain an account. To create an account, you must (i) be at least 18 years of age or acting under the supervision of a parent or legal guardian who has agreed to be bound by the WhiteSky Terms on your behalf; and (ii) provide (and subsequently maintain) accurate and up-to-date requested information. Subject to the restrictions in the WhiteSky Terms, you grant us the right to use this information you provide for the purpose of delivering the WhiteSky Services.
2. REALPAGE PARTY
The RealPage Party that provides the WhiteSky Services is WhiteSky Communications, LLC.
3. PRIVACY POLICY
The collection, use and sharing of information you provide when registering for and using the WhiteSky Services is subject to the RealPage Privacy Policy at https://www.realpage.com/legal/privacy-policy/.
4. WHITESKY ACCEPTABLE USE POLICY
Because network resources are shared by all users, WhiteSky has implemented certain policies to govern Your use of the WhiteSky Services. These policies are designed to: (a) ensure that shared network resources are allocated fairly among all users; (b) allow users and prospective users to understand service policies and any significant limitations on the WhiteSky Services; and (c) provide a foundation that assures customers that they can rely on consistently receiving the level and quality of service to which they subscribe. WhiteSky does not block access to, nor discriminate against, any lawful website or Internet application and, with respect to the WhiteSky Services, supports the ability of users to select and attach the equipment of their choice to the network so long as that equipment: (i) is certified by the Federal Communications Commission (FCC); (ii) is used for a lawful purpose consistent with the WhiteSky Terms; and (iii) does not harm the network or degrade network performance for other users. All users are fully responsible for securing their equipment, including wireless routers, to prevent unauthorized access to the network by third parties and will be held fully responsible for the actions of such third parties that gain unauthorized access to the network through unsecured end user equipment.
The WhiteSky Services are made available to You for Your reasonable, personal, non-commercial use only. RealPage reserves the sole discretion to deny or restrict Your access to the WhiteSky Services, if Your use is objectionable or unlawful, interferes with the functioning or use of the WhiteSky Services, or violates the WhiteSky Terms. The following is a non-inclusive list of examples of conduct which may lead to termination of Your access to the WhiteSky Services:
- Resell or to permit or facilitate the use of the WhiteSky Services, in whole or in part, directly or indirectly, by other persons or entities, regardless of whether for a fee or profit, and regardless of the method (e.g., through Wi-Fi or other methods of networking);
- Use or run programs or dedicated, stand-alone equipment or servers from Your premises that provide network content or any other services to anyone outside of such premises’ local area network, also commonly referred to as public services or servers (e.g., web hosting, file sharing, peer-to-peer servers, and proxy services and servers);
- Access without permission the accounts or computer systems of others, to spoof the URL, DNS or IP addresses of RealPage or any other entity, or to penetrate the security measures of the WhiteSky Services or any other person's computer system, or to attempt any of the foregoing;
- Transmit uninvited communications, data or information, or engage in other similar activities, including without limitation, spamming, flaming or denial of service attacks;
- Introduce viruses, worms, harmful codes or Trojan horses on the Internet;
- Use the WhiteSky Services to host, post, view or transmit any content that is obscene, indecent, hateful, malicious, racist, defamatory, fraudulent, libelous, violent, or that promotes the use of violence or harm to others, including any content that harasses, or threatens the health or safety of others;
- Violate RealPage’s or any third party's copyright, trademark, proprietary or other intellectual property rights;
- Engage in any conduct harmful to the WhiteSky network, the Internet generally or other Internet users;
- Use the WhiteSky Services for any activity which may violate any laws, rules or regulations of any governmental authority;
- Violate any export control laws, or download or use the WhiteSky Services in destinations that are otherwise controlled or embargoed under U.S. law, as modified from time to time; or
- Engage in deceptive trade practices or consumer fraud, such as illegal gambling, “make money fast” schemes, chain letters, pyramid or other investment schemes, or to make or encourage other persons to accept fraudulent offers for services or products.
5. WHITESKY SERVICES AVAILABILITY
You acknowledge that there may be interruptions in your access to the WhiteSky Services. While RealPage makes reasonable efforts to keep the WhiteSky Services accessible at your property, the WhiteSky Services may be unavailable from time-to-time for any reason including system down time for routine maintenance or due to events that are beyond our control—such as interruptions in service caused by a Force Majeure event, general Internet outage, failure of your property’s infrastructure or connectivity, computer and telecommunications failures and delays, and network intrusions or denial-of-service or other criminal attacks. RealPage is not responsible for any connectivity issues you may experience when accessing the WhiteSky Services or for any delays or loss of material, data, transactions or other information caused by system outages, whether planned or unplanned.
6. SMS TEXT ALERTS AND OTHER WHITESKY SERVICES-RELATED NOTIFICATIONS
You understand and agree that by providing us with your mobile phone number you consent to being contacted at that number by a person, and via prerecorded voice messages and automatic telephone dial devices relating to the WhiteSky Services. You also consent to receiving WhiteSky Services-related emails to any email address that you provide. We may offer you the ability to enroll your mobile phone number in our Short Messaging Service text message service (the "SMS Service") for purposes of receiving messages from RealPage regarding information, resources, and marketing materials related to the WhiteSky Services in the form of: operational alerts and reminders from your property management company, marketing communications and information for Services available for your property, and digital tools and other communication materials.
- Enrollment and Consent. If SMS Service is made available to you through the WhiteSky Services, by providing your mobile phone number(s) and opting in to the SMS Service:
- You authorize RealPage and your property management staff to send text messages to the mobile phone number(s) included in your WhiteSky Services profile.
- ii. You acknowledge and agree that your completion of the online registration process constitutes your written, express consent to enroll your mobile phone number(s) in the SMS Service.
- You confirm that you are the owner or subscriber of the mobile phone number(s) and authorized to enroll them in the SMS Service. The number of non-solicited text messages received from the SMS Service may vary.
- Opting Out. You may cancel your enrollment in the SMS Service at any time by:
- Removing your mobile phone number(s) from the SMS Service registration; or
- Text "STOP" in reply to any text message received from the SMS Service.
- SMS Service Availability and Other Information. The SMS Service relies upon third party wireless service provider networks to deliver text messages. RealPage is not liable for the availability (or lack thereof) of wireless network coverage or the failure of the wireless networks to deliver a text message. RealPage disclaims any responsibility for any wireless service used to access the SMS alerts. RealPage SMS alerts are available to users based in the United States. You understand and acknowledge that SMS alerts are not intended to be accessed from outside of the United States. Wireless carriers are not liable for delayed or undelivered messages. Message and data rates may apply.

RealPage will reasonably attempt to resolve any questions, problems, or complaints received; however, some items may not be within our control. For any complaints or questions concerning any third-party applications or services that you subscribe to, please contact those vendors directly for support. RealPage is not responsible, or liable, for any problems resulting from the use of third-party vendors, and generally will not be able to answer questions or provide support for these applications.
