“Multifamily Super Heroes” Video Contest Official Rules (Official Rules)

Eligibility: Eligibility for RealPage’s “Multifamily Super Heroes” Video Contest (the “Video Contest”) is limited to legal residents of the 50 United States (including the District of Columbia) who are at least 18 years of age at time of entry. Employees of RealPage, Inc., or any of their subsidiaries or affiliates, their advertising or promotion agencies, those involved in the production, development, implementation or handling of the Video Contest, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers, prize suppliers, and any other person or entity associated with the Video Contest (collectively “Video Contest Entities”) and/or the immediate family (spouse, parents, siblings and children) and household members (regardless of whether related) of each such employee are not eligible. Video Contest is subject to all U.S. federal, state and local laws and regulations. Void in and where prohibited by law.

Sponsor: The Video Contest is sponsored by RealPage, Inc., 4000 International Parkway, Carrollton, TX 75007 (“Sponsor”).

Agreement to Official Rules: By entering the Video Contest, entrant accepts and agrees to these Official Rules and the decisions of the Sponsor, which are final and binding. All requirements set forth in these Official Rules must be met in order to win a prize.

Video Contest Period: The Video Contest begins at 8:00 AM (PST) on April 15, 2013, and ends at 12:00 AM (midnight) (PST) on May 31, 2013 (the “Contest Period”). Entries received prior to or after the Contest Period will not be accepted.

How to Enter: To enter, you must upload your video to your own personal or professional video channel. You must provide us with the link, along with your name, company name, email, and address via the online contest application form at www.realpage.com/realworld/realworld-video-contest/ and agree to the Official Rules and the Contest Terms. You will be required to provide a physical street address for entry (PO Boxes ineligible). All videos must be relevant to the topic, “Multifamily Super Heroes.” Any video that is not relevant to the topic will not be eligible for judging. All videos must be submitted by 12:00 AM (midnight) (PST) on Friday, May 31, 2013, to be considered for voting. Limit of one entry per person or team of up to three individuals. Individuals may not submit a separate video if the individual has already submitted a video as part of a team of up to three individuals.

Any attempt to obtain more than one entry per entrant by any method (including, but not limited to using multiple/different email addresses, identities, registrations and logins) will void such entries and that entrant may be disqualified. The Video Contest strictly prohibits use of any computer system or automated system to enter, and any attempt to do so will result in disqualification. Access and usage charges imposed by your Internet Service Provider may apply.

Selection and Voting: After 12:00 AM (midnight) (PST) on Friday, May 31, 2013, all videos submitted will be judged by a Video Contest committee comprised of RealPage employees. Two finalists, either individuals or teams of up to three individuals (the “Finalists”), will be chosen solely by the RealPage Video Contest committee based on the following criteria: Originality/creativity, relevance to the topic, and overall quality. The two Finalists will be announced no later than June 10, 2013. The Finalists will receive, at not charge, a registration fee to the RealWorld 2013 User Conference in Denver, Colorado. This is limited to the conference registration fee only. Finalists must provide, at their own expense, travel arrangements, including airfare and hotel. While attending the User Conference, one of the two Finalist’s videos will be voted as the Grand Prize Winner by conference attendees. There will be an opportunity for all conference attendees to view both Finalists’ videos during the User Conference and vote on which one they feel deserves to win. The Grand Prize Winner will be announced Tuesday, July 16, at the conference during the luncheon event.

Entry into the contest constitutes consent by the entrant for the Sponsor to view, use, display and publish the video and the entrant’s or entrants’ name(s) and other information submitted as part of the entry. By entering into the Video contest, the entrant grants to RealPage a world-wide, fully paid, perpetual and transferable right and license to view, use, display and publish the video without any compensation to the entrant(s). You are responsible for obtaining all third party consents required to make and publish your video.

Requirements of the Potential Grand Prize Winner: The Finalists will be required to complete and return the following documents within a specified time period: an affidavit of eligibility, a liability release, and, except where prohibited by law, a publicity release (the “Affidavit/Release”) and IRS W-9 form. If the Finalists fail to sign and return these documents within the specified time period, an alternate entrant may be selected in his/her place at the RealPage Video Contest committee’s discretion. Prize acceptance constitutes winner’s consent to the use of his/her name, image, likeness, photograph, voice, and biographical material for advertising, publicity and promotional purposes by Sponsor, and its designees, including but not limited to online announcements, without additional compensation, except where prohibited by law.

Prizes: The Finalists will receive, at no charge, a registration to RealWorld 2013 in Denver, Colorado, that is limited to the conference registration fee only. The Finalists will be solely responsible for all costs and expenses not specifically mentioned herein, including, but not limited to, airline fares, hotel, and taxes. The Finalists will be required to attend RealWorld 2013 in Denver in order to be eligible to win. At least one individual from a team submission must attend RealWorld 2013 in Denver to be eligible. The Grand Prize Winner will receive $1,000. The Runner Up will receive $500.

General Conditions: If the Video Contest operation, security, or implementation is impaired for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) temporarily suspend the Video Contest, address the impairment and then resume the Video Contest in a manner that best follows these Official Rules; or (b) conduct a random drawing using only the eligible entries received up to the time of the impairment. Any individual found to be tampering with the entry process or Video Contest in any way or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner will be subject to disqualification at the Sponsor’s sole discretion. Any attempt by any person to circumvent the requirements or the operation of the Video Contest may constitute a violation of criminal and civil law, and, the Sponsor reserves the right to seek damages to the fullest extent permitted by law from any such person. No provision is waived due to the Sponsor’s failure to enforce any term of these Official Rules. In case of a dispute as to the owner of an entry, entry will be deemed to have been submitted by the authorized account holder of the screen name from which the entry is made. The authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any use of copyrighted material not belonging to the video entrant will result in an automatic disqualification from the video contest.

Release and Limitations of Liability: By participating in the Video Contest, each entrant agrees to release and hold harmless the Video Contest Entities from and against any liability, claim, damages or cause of action arising out of participation in the Video Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Video Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Video Contest or the processing of entries; (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Video Contest or receipt of any prize; or (g) infringement of any third party patent copyright or trademark or misappropriate any third party trade secret or other third party intellectual property right. Each Entrant further agrees that in any cause of action, the Video Contest Entities’ liability will be limited to the cost of entering and participating in the Video Contest, and in no event shall the Video Contest Entities be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Video Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsors in connection with the Video Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.

Video Contest Results: Video Contest results will be available to interested persons sending a request for results and a self-addressed, stamped envelope to MULTIFAMILY SUPER HERO VIDEO CONTEST, C/O RealPage, Inc., 4000 International Parkway, Carrollton, TX 75007. All requests must be received by July 29, 2013.
